New Jersey Affirms Driving While Intoxicated Conviction

The New Jersey Appellate Court affirmed a Driving While Intoxicated conviction. The Defendant was charged with a violation of N.J.S.A. 39:4-50. The Defendant was found sleeping in the front seat of an automobile in front of a local convenience store with the vehicle running. Upon arrival of the police he was found to also have prescription pills and a half eaten sandwich on the driver's seat The Appellate Division found that was "operation" for purposes of the aforementioned statute upholding the conviction.
