These cases all involve the over serving of alcohol to visibly intoxicated patrons of businesses by the business or their employees. That is the traditional dram shop act. Being served while visibly intoxicated is required to establish liability against the bar, tavern or restaurant, which can be established through numerous factors including: the individuals, blood alcohol content (BAC); witness testimony, video evidence and expert testimony of a toxicologist.
